Resumen de La ley orgánica de regulación de la eutanasia: Valoración global y primeras dudas interpretativas

Frente a quienes tachan a la LORE de inconstitucional, desde un frente, y de insuficiente, desdeel extremo opuesto, en este trabajo se valora como una regulación compatible con la Constitución de 1978, equilibrada y razonable. Tras unas observaciones preliminares en relación a lainminente interposición de un recurso de inconstitucionalidad contra la ley, se repasan y contextualizan los rasgos básicos del modelo adoptado por el legislador español; el balance globalpositivo no es óbice, sin embargo, para poner de manifiesto algunas deficiencias y ciertas dudasinterpretativas sobre aspectos concretos.

The new Spanish euthanasia regulation has been deemed both unconstitutional and, from theopposite perspective, too weak in guaranteeing the fundamental right of the individual to decide over his or her own death. In this paper it is considered, on the contrary, mostly a reasonableand pondered regulation. After some preliminary considerations regarding the appeal against itto be shortly filed before the Constitutional Court, the fundamental aspects of the new law arereviewed and put into context. The globally positive outcome cannot hide, however, some deficiencies and interpretative difficulties regarding particular aspects which are brought into view..
