La necesaria previsión legal de la declaración del coacusado en el acto del juicio oral

    La declaración del acusado prestada en el acto del juicio cuando incrimina a otro acusado carece de regulación legal en España. La jurisprudencia del Tribunal Supremo y la doctrina del Tribunal Constitucional han ido construyendo unos criterios que no se compadecen, a nuestro juicio, ni con las previsiones legales del CEDH ni con la jurisprudencia del TEDH. Como veremos a lo largo del presente artículo, la regulación contenida en la norma italiana supone una solución idónea y adecuada, tanto para valorar la prueba como para garantizar los derechos reconocidos en el artículo 6 del CEDH.

    The defendant’s statement during the trial when another defendant is incriminated lacks of legal regulation. The Supreme Court’s case law and the doctrine of the Constitutional Court have gradually built some criteria that do not fit, in our opinion, nor with the legal provisions of the ECHR neither with the jurisprudence of the European Court of Human Rights. As we will see throughout this paperwork, the legal provision foreseen in the Italian regulation would be an appropriate solution, both to appraise the evidence and to guarantee the rights recognized in Article 6 of the ECHR.
