El nuevo art. 808. IV CC regula un fideicomiso de residuo que grava las legítimas estrictas de los hijos no discapacitados del testador para fortalecer la posición del que se encuentre discapacitado en las condiciones que la ley /2021 detalla. The new art. 808. IV Spanish Civil Code regulates a trust residue that encumbers the strict legitimate rights of the non-disabled children of the testator in order to strengthen the position of the one who is disabled under the conditions that the law /2021 details. The requirements to be a trustee have changed, made the comparisons with the regulation of the trust substitution mentioned in the repealed art. 808.III CC. What repercussion will this measure have on the position of other relatives of the testator?
