Proceso ordinario, ejecución de sentencia y ejecución hipotecaria: ¿caminos compatibles?.

    En el presente trabajo se estudia la potencial compatibilidad de la prioridad registral, de la que goza una hipoteca, con la posible opción del acreedor hipotecario de vencer anticipadamente la totalidad del crédito en un proceso declarativo anterior y la ejecución de su sentencia. Entre otras cuestiones nos pronunciaremos en la necesidad de inscribir o no el embargo de un crédito garantizado con hipoteca. Y, en concreto, nos detendremos en el problema de las llamadas cargas intermedias, como embargos inscritos entre la constitución de la hipoteca y el embargo ejecutivo derivado de dicho crédito, para argumentar una posición favorable al mantenimiento de la prioridad registral.

    This article studies the possible compatibility of the priority registration of a mortgage with the possible option of the mortgagee to the repayment of the entire credit in a prior declaratory process and the execution of its judgment. Among other issues we will decide whether or not to register the seizure of a mortgage-secured loan. Specifically, we will consider the problem of so-called intermediate charges, such as liens registered between the constitution of the mortgage and the executive seizure derived from such credit, in order to argue a position in favor of maintaining the priority of the registry.
