    El empresario debe informar al consumidor, cuando rija alguna excepción a su derecho de desistimiento, de que tal derecho no le asiste; sin embargo, nuestra ley no prevé la sanción civil de incumplir tal deber. En este trabajo analizaremos tres posibles soluciones a esta laguna legal: la responsabilidad del Estado por incumplimiento del Derecho Comunitario; la concesión analógica de un derecho de desistimiento; y la ineficacia del contrato.

    The trader must inform the consumer, whenever there is an exception to his right of withdrawal, that such right does not assist him; however, our law does not specify the civil consequences of neglecting this obligation. In this paper, we will analyze three possible solutions to this legal tap: State liability for the infringement of Community law; granting the consumer a right of withdrawal analogically; and the inefficacy of the contract.
