    La protección o el bienestar animal no se mencionan expresamente en nuestra Constitución aunque sí son objeto de múltiples convenios internacionales y son hoy un valor en nuestra sociedad. La Sentencia del Tribunal Constitucional 81/2020, de 15 de julio, contiene un importante pronunciamiento sobre la consideración que tiene el bienestar animal en nuestro ordenamiento y sobre los límites que deben de tener en cuenta los Parlamentos autonómicos a la hora de legislar en esta materia. En este trabajo se analiza dicho pronunciamiento y se exponen las razones que permitirían una interpretación abierta de la Constitución donde tuviera cabida la protección de los animales, y un diferente entendimiento de las relaciones entre normativa estatal y autonómica en esta materia.

    Animal welfare is not expressly mentioned in the Spanish Constitution, although it is the subject of multiple international Conventions and is today a value in our society. The Judgment of the Constitutional Court nº 81/2020 contains an important statement on the consideration of animal welfare in Spanish legal system and on the limits that regional parliaments must take into account when legislating on this matter. This article analyzes this sentence and sets out the reasons that would allow another interpretation of the Constitution where animal welfare had a place and a different understanding of the relations between Spanish government and regional parliaments in this matter are exposed.
