Las especialidades facultativas del ámbito de la salud mental ante los tribunales de justicia

    Los médicos psiquiatras y los psicólogos especialistas en psicología clínica asesoran frecuentemente a la Justicia como peritos en asuntos relacionados con la salud mental. Pero otros muchos facultativos sanitarios lo hacen también, incluyendo los generalistas, aduciendo a veces la sola experiencia en la materia frente a la necesaria especialización. Como es lógico intervienen igualmente los especialistas en medicina legal y forense, y los médicos forenses calificados por el Ministerio de Justicia, pero que raramente son también psiquiatras titulados. En la práctica, bastantes de esos facultativos pretenden estar al mismo nivel comparativo de competencias aplicadas sobre salud mental, lo que puede ser difícil y seguramente incierto. En este artículo y de acuerdo con la legislación vigente se enfatiza la óptima cualificación profesional exigible para poder actuar como perito en salud mental, lo que viene mínimamente garantizado por las especializaciones oficiales correspondientes.

    Background: Imputability is the ability to apply the charges that are attributed to a person by law who has performed certain acts. The existence of certain disorders of a psychiatric nature that may partially or totally nullify consciousness and will, temporarily or permanently, makes it necessary to evaluate the presence of these alterations at the time of the facts, to know if the person is susceptible to the application of all charges for which he is charged. Aim: Describe the bibliographic evidence on the application of the psychiatric expert test and how it influences and its results, in the diagnosis of certain pathologies of a psychiatric nature, in the establishment of the legal concept of imputability. Material and Method: A comprehensive bibliographic search is performed in different specialized medical databases, using keywords and inclusion criteria. From the resulting publication sample, relevant articles were selected to extract the results and conclusions. Results: The results of the bibliographic search, on psychiatric disorders that would modify the imputability of an individual when committing criminal acts, are obtained. Here it is observed that it not only depends on the type of mental disorder that is suffered, but on its intensity, how it affects the judgment of reality and the will of the person who suffers from them. In this way they will be classified as total, partial or null affectation of the imputability.

    Conclusions: In conclusion, to carry out a correct assessment of the imputability when judging by the criminal acts carried out by a person, it is necessary on many occasions to carry out a psychiatric expert test that allows us to know the mental disorder that is suffered and its intensity.
