Del transconstitucionalismo a la transdemocracia

    El presente artículo se vincula al proyecto “transdemocracia”, que actualmente desarrolla el autor. Usando este enfoque, se propone abordar los límites del Estado intercultural en el contexto de las democracias occidentales. Para esto, comienza con una discusión sobre el “transconstitucionalismo” y sus límites. El transconstitucionalismo se refiere a la vinculación de múltiples ordenes legales del mismo o diferente tipo, de forma simultánea con el mismo problema o caso constitucional, esto es, cuestiones constitucionales relacionadas a los derechos fundamentales o limitación y control jurídico del poder político. Los problemas constitucionales, por lo tanto, van más allá del Estado, enmarañando varios ordenamientos jurídicos, aunque no surja ninguna Constitución en este contexto. En estas líneas, se apuntan los límites de dicha concepción en una sociedad mundial asimétrica con la finalidad de buscar nuevas alternativas. Dentro de estas, dos alternativas surgen con fuerza: por una parte, el post-constitucionalismo, que demanda la trascendencia de la sociedad mundial actual y, por lo tanto, niega el constitucionalismo en general; y, por otra, la transdemocracia, que se presenta como inmanente a nuestra formación social y pretende ser complementaria al transconstitucionalismo. Debido a que el autor se inclina por la segunda alternativa, el artículo esboza el concepto de transdemocracia como un enfoque que busca traspasar las fronteras estatales e ir más allá de la soberanía popular y el ya clásico “Nosostros, el Pueblo”, y enfatizar la capacidad de respuesta sostenible para los otros pueblos de la sociedad mundial. Se afirma, que esto es una cuestión de sostenibilidad de la democracia a largo plazo. Para esto, el autor se propone desarrollar un enfoque ecológico de la democracia con el trasfondo de la teoría de sistemas de Niklas Luhmann, pero desde una perspectiva crítica y heterodoxa.

    This article relates to the author’s project “transdemocracy” and with this approach proposes to address the limits of the intercultural state in the field of Western democracies. It starts with a discussion of “transconstitutionalism” and its limits. Transconstitutionalism concerns the fact that multiple legal orders of the same or different kind are simultaneously involved with the same constitutional issue or case, that is issue or case concerning basic rights or legal limitation and control of political power. Constitutional problems, thus go beyond the state and entangle several legal orders, although no new constitution arises in this context. The article points out the limits of transconstitutionalism in an asymmetric world society so as to seek new alternatives beyond it. t is with this approach that he proposes to address the limits of the intercultural state in the field of Western democracies Two alternatives are considered: post‐constitutionalism, which demands transcendence of today's world society and thus negate constitutionalism in general, and transdemocracy, which is rather immanent to our social formation and claims to be complementary to transconstitutionalism. Because the author prefers the second alternative, the article begins to outline an approach to transdemocracy that goes across state boundaries and beyond “We the People”, that is popular sovereignty, in order to emphasize the sustainable responsiveness for other peoples in the same world society. It is a question of sustainability of democracy. In this context, the author intends to develop an ecological approach to democracy with the background of Niklas Luhmann's systems theory, but from a heterodox, critical perspective.
