    El Tribunal Supremo, en la sentencia 124/2021, de 3 febrero, interpreta la confusa regulación contenida en el artículo 42 del Estatuto de los Trabajadores, respecto a la responsabilidad del empresario principal por las deudas en materia de Seguridad Social y el alcance liberatorio de los certificados de descubiertos.

    La Sala resuelve que esta regulación no permite atribuir responsabilidad solidaria al empresario principal por las deudas que tuviere el contratista o subcontratista con la Seguridad Social anteriores a su contratación o subcontratación y que la emisión de certificados negativos, por la TGSS, no exonera al empresario principal de responsabilidad solidaria salvo que la información sea errónea.

    The Supreme Court, in sentence 124/2021, of February 3, interprets the confusing regulation contained in article 42 of the ET, regarding the responsibility of the main employer for debts in Social Security matters and the liberatory scope of the certificates of discovered.

    The Chamber finds that this regulation does not allow attributing joint liability to the principal employer for the debts that the contractor or subcontractor may have with Social Security prior to their hiring or subcontracting and that the issuance of negative certificates, by the TGSS, does not exonerate the main employer from joint and several liability unless the information is wrong.
