Resumen de La inclusión financiera en el derecho positivo argentino

En este trabajo nos proponemos analizar el fenómeno de la inclusión financiera desdeel punto de vista jurídico, explorando cuáles son las disposiciones existentes en nuestro derecho tendientes a promover y favorecer a la misma. También examinaremos cómo la transformación digital afecta a los servicios bancarios tradicionales a partir del uso de la tecnología y cómo las fintech contribuyen a potenciar el acceso al financiamiento. Del mismo modo trataremos de analizar el rol que juegan otras instituciones en este proceso y haremos referencia, en la medida de que sea relevante, a la normativa del erecho comparado y al aporte de organismos internacionales en torno a este tema.

In this paper we propose to analyze the phenomenon of financial inclusion from the legal point of view, exploring what are the existing provisions in our law tending to promote and favor it. We will also examine how digital transformation affects traditional banking services through the use of technology andhow fintech contributes to increasing access to financing. In the same way we will try to analyzethe role played by other institutions in this process. and we will refer, to the extent that it is relevant, of the regulations of comparative law and the contribution of international organizations on this issue.
