The VAT law in its article 108 defines the concept of capital assets.
In order to avoid possible distortions or frauds, it establishes an adjustment mechanism in this type of property that goes beyond that of the year in which it is acquired.
We will work at the time of acquisition of the asset with the final prorate of the previous year as provisional. At the end of the year, we must calculate the final prorate for this year and make the relevant adjustment, reflecting the positive or negative difference. In investment property we must regularise the VAT that we deduct in the acquisition period during the four or nine (in the case of land or buildings) natural years following that in which the taxpayer.
This period begins to count from the calendar year in which the investment assets come into operation.
