Il contributo, partendo dalla sentenza pronunciata dalla Corte di Strasburgo, si sofferma sul tema della rinnovazione dell’istruttoria nel caso di reformatio in peiusin appello. Vengono analizzati, dunque, gli orientamenti della Corte EDU in ordine al canone dell’equità di cui all’art. 6 C.E.D.U., e le proiezioni dell’art. 603 c.p.p. L’A. si sofferma, infine, sull’efficacia panprocessuale della pronuncia, nell’ottica dell’art. 630 c.p.p. e della sorte dei “fratelli minori” dell’applicant
The paper, starting from the sentence pronounced by the Court of Strasbourg, focuses on the issue of the renewal of the investigation in the case of reformatio in peius on appeal. Therefore, the guidelines of the ECHR regarding the canon of equity referred to art. 6 of the Convention, and the projections of art. 603 c.p.p. Finally, the Author focuses his attention on the pan-procedural efficacy of the ruling, in the perspective of art. 630 c.p.p. and the fate of the applicant’s “younger brothers”
