    The paper aims to “re-read” Beccaria’s work, highlighting its historical “root” and real “philosophy”. It will be observed, then, that the matrix of Dei Delitti e delle Pene is represented by the need to adapt the penal system to the evolutions of the social context of the time, marked by the decline of the ancien régime. It will be illustrated, therefore, how the basic idea of the pamphlet is represented by a penal system strongly oriented towards general negative prevention that, after the French Revolution, will be fully taken up by the most important European codifications, as instrumentum regni, to protect the Borghese state from anti-social conduct, especially against property, widespread in the lower classes

    Il contributo si prefigge lo scopo di “rileggere” l’opera di Beccaria, mettendone in luce la “radice” storica e la reale “filosofia”. Si osserverà, allora, che la matrice di Dei Delitti e delle Pene è rappresentata dalla necessità di adeguamento del sistema penale alle evoluzioni del contesto sociale dell’epoca, segnata dalla decadenza dell’ancien régime. Si illustrerà, dunque, come l’idea di fondo del pamphlet sia rappresentata da un sistema penale fortemente orientato alla general prevenzione negativa, che successivamente, e cioè dopo la Rivoluzione francese, verrà ripresa a piene mani dalle più importanti codificazioni europee, quale instrumentum regni, e cioè quale mezzo per tutelare lo Stato borghese rispetto a condotte antisociali, specie contro la proprietà, diffuse nelle classi inferiori
