La reivindicación de los trabajadores por participar en la gestión y propiedad de las empresas y su interés en resolver las situaciones de crisis suscitadas en las mismas, ha motivado que, desde hace varias décadas, se busquen nuevas fórmulas para facilitar el acceso del trabajo a los medios de producción. Una de las instituciones que permite, en cierta medida, superar el antagonismo capital trabajo en la organización empresarial son las sociedades laborales. Su origen -como la mayoría las instituciones mercantiles- no puede buscarse en fuentes legales, sino que su nacimiento se encuentra en los usos "ad hoc" de la práctica de las empresas.
