Los derechos culturales como libertades y su problemática en el Perú

    El presente artículo se basa en la tesis que sustenté en febrero de 2020 para optar el grado de magíster en Derechos Humanos, donde sostengo que los derechos humanos culturales, reconocidos en el primer párrafo del artículo 27 de la Declaración Universal de Derechos Humanos, son libertades de acuerdo con el concepto establecido por el jurista alemán Robert Alexy. Asimismo, se identifica en la normativa peruana de rango infraconstitucional una mayor atención por parte del Estado a sus obligaciones de protección del patrimonio cultural en desmedro de sus obligaciones de garantizar el pleno ejercicio de los derechos culturales en su naturaleza de libertad, que incluyen abstenerse de intervenir en el ejercicio de las prácticas culturales y en el acceso a los bienes culturales y a la par de realizar acciones para asegurar que existan condiciones para ambas prácticas. Se identifica la relevancia de esta tesis en la posibilidad de generar conciencia en funcionarios y servidores del sector cultura peruano sobre la naturaleza de libertad de los derechos culturales para la más idónea prestación de sus servicios.

    This article is based on the thesis that I supported in February 2020 to earn the master’s degreein Human Rights from the Pontificia Universidad Católica del Perú, where I argue that culturalhuman rights, recognized in the first paragraph of article 27 of the Declaration UniversalHuman Rights, are freedoms according to the concept established by the German jurist RobertAlexy. Likewise, the Peruvian legislation of infra-constitutional rank identifies greater attentionby the State to its obligations to protect cultural heritage to the detriment of its obligations toguarantee the full exercise of cultural rights in their nature of freedom, which include abstainingto intervene in the exercise of cultural practices and in the access to cultural property and, at thesame time, to carry out actions to ensure that conditions exist for both practices. The relevanceof this thesis is identified in the possibility of generating awareness in officials and servants ofthe Peruvian culture sector about the nature of freedom of cultural rights for the most suitableprovision of their services.
