Durante la II República española, las reformas militares de Azaña in- cluyeron la reforma de la justicia militar, entre otros aspectos para suprimir el Consejo Supremo de Guerra y Marina y atribuir sus competencias a la Sala 6.ª del Tribunal Supremo, dejando en su mayoría vigente el Código de Justicia Militar de 1890.
En este contexto, la sublevación del general Sanjurjo de agosto de 1932 dio lugar a diversas sentencias del Tribunal Supremo sobre el delito de rebelión militar, en las que sentó su doctrina sobre el tema.
El objetivo del trabajo es analizar, a la luz de dichas sentencias y nuevos documentos, el consejo de guerra del sargento Diego Vázquez, participante en los sucesos revolucionarios de octubre de 1934 y único militar ejecutado por el delito de rebelión militar durante el periodo re- publicano, previo a la Guerra Civil. Utilizando este caso paradigmático podemos ver algunos de los defectos de la justicia militar de la época y como la nueva interpretación del Tribunal Supremo no fue tenida en cuenta en este caso.

The aim of this paper is to analyze, in the light of those sentences and new documents, the court martial of Sergeant Diego Vázquez, who partici- pated in the revolutionary events of October 1934 and was the only mili- tary executed for the crime of military rebellion during the Republican pe- riod, prior to the civil war. Using this paradigmatic case, we can see some of the defects of military justice at the time and how the new interpretation of the Supreme Court was not taken into account in this case.
