El presente trabajo tiene por objeto el análisis de la sentencia del TEDH Centro para la Democracia y Estado de Derecho c. Ucrania, de 26 de julio de 2020. La elección de este caso radica en que es el primer pronunciamiento del TEDH sobre el acceso a la información pública dictado en pleno contexto de pandemia. Esta circunstancia, hace que el asunto cobre especial relevancia para revisar el nivel de protección otorgado por el TEDH en la materia. Ya que, el Tribunal de Estrasburgo tiene desde 2016 una línea doctrinal definida a favor del derecho en el marco del art. 10 CEDH. Así pues, una vez contextualizada la relevancia democrática del derecho y las carencias a las que se ha visto sometido con carácter general en el marco de la crisis sanitaria, se reflexionará sobre la posición estratégica mantenida por el TEDH en este reciente e importante asunto.
The purpose of this paper is to analyse the judgment of the ECtHR Centre for Democracy and the Rule of Law v. Ukraine, 26 July 2020. This case was chosen because it is the first decision of the ECtHR on access to public information issued in the pandemic context. This circumstance makes the case particularly important when it comes to review the current level of protection granted by the ECHR in this matter, given that the Strasbourg Court has already had a defined doctrinal line in favour of the right since 2016 based art. 10 ECHR. Thus, once it is contextualized the democratic relevance of the right and the deficiencies which it has been in general subjected to the framework of the health crisis are contextualized, we will reflect on the strategic position maintained by the ECtHR in this recent and important case.
