En el presente trabajo abordaremos el análisis relativo a posibilidad de impugnar por error la aceptación de la herencia ─a través del comentario de la STS de 15 de marzo de 2021 (JUR 2021/99291) ─ acto éste sustancialmente irrevocable; dada la posterior aparición de una deuda desconocida por el heredero que acepta pura y simplemente.

In this paper we will address the analysis regarding the possibility of impugn the acceptance of an inheritance due to a defect in consent (in particular, due to the so-called “error vicio”) ─through the commentary of the STS 15 March 2021 (JUR 2021/99291) ─ being that legal act substantially irrevocable; given the emergence of an unknown inheritance debt by the heir who accepted the referred inheritance.
