This note comments on the judgment of the Court of Cassation of 5 July 2019, no. 18201, going over the main decisions in case-law and the trends in legal doctrine in the identification of a discrimen between secondary insiders pursuant to Article 187-bis, paragraph 4, of the Consolidated Financial Act and outsiders in complicity with primary insiders pursuant to Article 110 of the Criminal Code, and analyzing the evolution of European and national legislation on the subject.
La presente nota commenta la sentenza Cass., 5 luglio 2019, n. 18201, ripercorrendo i principali arresti della giurisprudenza e gli orientamenti della dottrina giuridica nell’individuazione del discrimine fra insider secondario ex art. 187-bis, comma 4°, t.u.f. e outsider in concorso con l’insider primario ex art. 110 c.p. e analizzando l’evoluzione legislativa europea e nazionale in materia.
