This essay aims to investigate the relationship between Abi omnibus guarantees and antitrust rules, coming to the conclusion that these guarantees do not contrast, from the ontological point of view, with these rules, both for formal reasons (as guarantees are proposals coming from guarantors and not from banks) and for the absence of free competition (as a guarantees’ market does not exist). The essay, moreover, analyses some procedural crucial questions, hampering the procedure leading “Bank of Italy” to issue provision n. 55 dd.

Il lavoro affronta il problema del rapporto tra fideiussioni omnibus Abi e disciplina antitrust, giungendo alla conclusione che tali fideiussioni non possono ontologicamente contrastare con tale normativa, sia per motivi formali (poiché le fideiussioni sono proposte provenienti dai fideiussori e non dalle banche), sia perché non esiste un mercato delle fideiussioni ove si possa esercitare la libera concorrenza. Il lavoro affronta, infine, anche alcune criticità procedurali, che hanno afflitto il procedimento che ha portato Banca d’Italia a emanare il provvedimento n. 55 del 2005.
