El alcance legal en España del certificado de ciudadanía de Puerto Rico

    El presente artículo realiza un análisis del reglamento 7347 por el cual se rige el proceso de evaluación y otorgamiento de certificados de ciudadanía de Puerto Rico. Igualmente se comenta brevemente el concepto de ciudadanía vis-avis nacionalidad. También reseña sucintamente elementos y requisitos para obtener la nacionalidad española. Así las cosas, se pasa a apuntar la eficacia que tiene el Certificado de Ciudadanía Puertorriqueña en el quehacer jurídico del ordenamiento español en cuanto a extranjería se refiera. Enfatiza en cómo el Certificado permite la coexistencia, simultaneidad y remanecía de ciudadanías y nacionalidades. Se argumenta la potencial novedad que implica esta eficacia no tan solo a un ‘nativo’ isleño sino a todo acreedor del Certificado independientemente de su lugar de origen.

    The present article analyses Regulation 7347 which governs the process of the evaluation and grant of Puerto Rico Citizenship Certificates. It briefly comments on the concept of citizenship vis-à-vis nationality. Also, it succinctly reviews the elements and requirements for obtaining Spanish nationality. The effectiveness of the Certificate of Puerto Rican Citizenship in the everyday legal framework of the Spanish system as far as foreigners are concerned is discussed point by point. The article emphasizes how the certificate permits the co-existence, simultaneity and resurgence of citizenships and nationalities. The potential novelty implied by this efficacy not only to a “native” islander but to anyone in possession of the certificate independent of their place of origin, is also discussed.
