El Derecho ambiental frente a los delitos ecológicos: la eficacia y eficiencia penal a debate

    El análisis del delito ecológico ha sido ampliamente debatido por la doctrina en nuestro país, teniendo en cuenta la gran cantidad de cambios de este no tan antiguo delito. Con el presente estudio abordamos en primer lugar la importancia que tienen los ecosistemas en el planteamiento de nuestro posicionamiento, donde el Derecho ambiental será fundamental para incrementar la eficiencia y eficacia de las normas establecidas, ante ese punto, realizamos un análisis del conocido como delito ecológico, llegando a trazar los límites de la intervención penal así como un análisis jurisprudencial de las sentencias dictadas en primera y segunda instancia por las audiencias provinciales durante el año 2019. Con este trabajo se pretende determinar el grado de eficacia y eficiencia existente en torno al delito ambiental.

    The analysis of ecological crime/environmental offence has been widely debated by the doctrine in our country, taking into account the large number of changes in this not so old crime. With this study we first address the importance of ecosystems in the approach of our position, where Environmental law will be essential to increase the efficiency and effectiveness of the established acts, before that point, we carry out an analysis of what is known as green crime since legal vision, reaching the limits of the criminal intervention as well as a jurisprudential analysis of the sentences handed down in the first and second instance by the provincial courts in 2019. This work aims to determine the degree of effectiveness and efficiency surrounding the crime environmental.
