    El presente trabajo analiza los diferentes sistemas de tratamiento que el Código penal establece con respecto a las personas jurídicas, dependiendo de si son consideradas como generalmente lícitas o forman parte de organizaciones criminales. Ello no solo permitirá diferenciar cuándo se tendrá que aplicar uno u otro sistema a una concreta entidad, sino que también ha servido para poner de manifiesto algunos de los problemas que plantea el muy diverso régimen que nuestro ordenamiento aplica a ambos grupos de personas morales cuando son consideradas como lo uno o lo otro. Precisamente por ello, el trabajo termina realizando algunas propuestas de lege ferenda tendentes a conseguir que nuestro sistema resulte preventivamente eficaz, pero también flexible y capaz de responder a la concreta realidad que presente cada entidad.

    This paper analyzes the different treatment systems that the Criminal Code in force establishes for legal persons, depending on whether they are considered as generally lawful or as a part of criminal organizations. It allows not only to determinate when each treatment will have to be applied, but also shows out some of the problems posed by the very diferent regime that our current penal system applies to each class of entities when they are considered as suchs. Therefore, finally, it is proposed some posible solutions to the detected problems with the goal of making the system preventively effective, but also flexible and appropriate to respond to the specific realities that each corporation can present.
