El artículo que a continuación se presenta, lleva por iniciativa reflexionar sobre los problemas jurídico-políticos acontecidos en el seno de la justicia constitucional del Estado mexicano, donde a partir del acto legislativo de una Entidad Federativa, se avizora una, más que clara, violación al mandato Constitucional de corte federal, donde los poderes constituidos regionales tergiversando su función y alcance, pretenden actuar como poderes constituyentes, creando y ejecutando, a contentillo e interés particular, cambios estructurales en sus aparatos normativos internos. Ello nos lleva a observar una evidente falla interpretativa en lo que debe entenderse por Constitución y Poder Constituyente, donde se pone en riesgo la comprensión del principio democrático de soberanía popular y del principio jurídico de supremacía constitucional. Ante ello, proponemos un estudio en un doble cauce: por un lado, abordaremos un trato teórico de las Ciencias Constitucionales al diferenciar entre Constitución y ley constitucional; y, por otro lado, realizaremos un estudio de interpretación jurisprudencial, sobre la base teórica que se postula.
The article that follows is presented, as an initiative, to discuss the legal-political problems that occurred within the Constitutional Justice of the Mexican State, where, from a legislative act of a Federal Entity, it is presented, violation of the Constitutional mandate Federal court, where the regional constituted powers, misrepresenting their function and scope, intend to act as constituent powers, creating and executing, to their own liking and particular interest, structural changes in their internal regulatory apparatuses. This leads us to observe an evident interpretive failure in what should be understood by Constitution and Constituent Power, where the understanding of the democratic principle of popular sovereignty and the legal principle of constitutional supremacy is put at risk. Given this, we propose a study in a double channel: on the one hand, we will address a theoretical treatment of Constitutional Sciences when differentiating between Constitution and Constitutional Law; and, on the other hand, we will carry out a study of jurisprudential interpretation, on the theoretical basis that is postulated.
