    El uso de una fotografía subida en una red social sin consentimiento del titular de la imagen que aparece en ella o del autor de la fotografía, supone vulneración a dos derechos: (i) por un lado al derecho fundamental a la propia imagen, que ostenta la persona que aparece en la fotografía; y (ii) a los derechos de propiedad intelectual que tiene el autor de la fotografía. En este sentido, habrá de solicitarse autorización para utilizar la misma y explicar los fines para los que se hará uso de ella.

    The use of a picture uploaded to a social network without the consent of the owner of the image that appears therein or of the author of the picture, entails the infringement of two rights: (i) on the one hand, the essential right to one's own image, held by the person depicted in the image; and (ii) on the other hand, the intellectual property rights held by the author of the picture. In this regard, the authorisation to use the picture must be requested and the purposes for which it is to be used must be explained.
