    Il lavoro, nell’analizzare le innovazioni introdotte dal CCI nella disciplina delle impugnazioni dell’accertamento del passivo nella procedura di liquidazione giudiziale e della stabilità dei relativi provvedimenti, si sofferma sui profili maggiormente controversi di questa disciplina. Esso si sofferma, in modo particolare, sulla natura dei rimedi impugnatori previsti dalla disciplina speciale e sulla dibattuta questione degli effetti dell’accertamento dei diritti di credito e dei diritti reali di terzi anche al di fuori della procedura di liquidazione giudiziale

    This work analyses the innovations introduced by the Italian Code of crisis and bankruptcy in the discipline about appeals for the assessment of the debts in the judicial liquidation procedure and about the stability of the related judgments and focuses on the most controversial aspects of this discipline. It focuses, in particular, on the nature of the appealing remedies provided by the special regulation and on the debated question of the effects of assessment of the credit rights and real rights of third parties even outside the judicial liquidation procedure
