Resumen de O direito fundamental de acesso à água e a interrupção do serviço de abastecimento de água potável ao consumidor inadimplente

  The present study seeks to analyze the grounds foreseen in the Brazilian legal system that authorize the recognition of access to treated water as a fundamental right, and the public water supply service is the main instrument for effective this right. It is noted that the right of access to water has been wrongly denied by the Brazilian courts when they recognize the legality of the suspension or interruption of water supply services in the event of user default. The decisions of the courts have valued the Brazilian legislation that authorizes the cut in essential public services, prevailing the patrimonial right of the concessionaires holders of public services to the detriment of the protection of the dignity of the human person and fundamental rights. The deductive method was adopted, based on bibliographic and legislative research in order to demonstrate the importance of raising water at the level of fundamental right, and later, to verify that the maintenance of public water supply services even in the face of user default is a measure that is imposed for the preservation of the dignity of the human person and of fundamental rights, assuring the concessionaire the right of action for the collection and satisfaction of your credit

  O presente estudo procura analisar os fundamentos previstos no ordenamento jurídico brasileiro que autorizam o reconhecimento do acesso à água tratada como um direito fundamental, sendo o serviço público de abastecimento de água o principal instrumento para a efetivação deste direito. Constata-se que o direito de acesso à água tem sido, equivocadamente, negado pelos tribunais brasileiros quando reconhecem a legalidade da suspensão ou interrupção dos serviços de abastecimento de água. As decisões dos tribunais têm valorizado a legislação brasileira que autoriza o corte nos serviços públicos essenciais, fazendo prevalecer o direito patrimonial das concessionárias em detrimento da proteção da dignidade da pessoa humana e dos direitos fundamentais. Adotou-se o método dedutivo, a partir de pesquisa bibliográfica e legislativa a fim de demonstrar a importância de elevar a água a nível de direito fundamental, para posteriormente, verificar que a manutenção dos serviços públicos de abastecimento de água mesmo diante do inadimplemento do usuário é medida que se impõe para a preservação da dignidade da pessoa humana e dos direitos fundamentais, assegurando-se à concessionária o direito de ação para a cobrança e satisfação do seu crédito.
