    O propósito desse texto, com base na análise bibliográfica e documental, é a investigação do conceito civilista de educação no Código Civil de 2002. Para tanto, o texto será dividido em três partes: num primeiro momento, contextualiza-se a relação entre a educação e a legislação civil, sobretudo aquela dos séculos XIX e XX, e, particularmente, apresentam-se as principais características do Código Civil de 1916, dando especial atenção à educação; num segundo, volta-se a atenção para a educação no Código Civil de 2002, em função do que se discutem a sua vinculação com o poder familiar, o âmbito da educação no Código Civil de 2002, bem como a concepção que esposa e a responsabilidade civil que têm os pais na tarefa de educação; finalmente, num terceiro momento, alvitra-se que a educação pode ser concebida, também, como um direito personalíssimo. Entende-se que, com isso, pode-se contribuir, de um lado, com a investigação da relação da educação com todos os ramos do direito, e, de outro lado, com a problematização dos fundamentos intrínsecos à legislação civil.

    The purpose of this text is, based on bibliographical and documentary analysis, to investigate the civil concept of education in the Civil Code of 2002. For this intent, the text will be divided into three parts: in the first part, the relationship between education and civil legislation is contextualized, especially of 19th and 20th centuries, and, in particular, the main features of the Civil Code of 1916 are presented, giving special attention to education; the second part focuses in education in the Civil Code of 2002, discussing its connection with family power, and also the scope of education in the Civil Code of 2002, as well as the conception of spouse, and parents civil responsibility in the task of education; finally, in a third moment, it is suggested that the education is also conceived as a personal right. It is understood that it can contribute to the investigation of the relationship of education with all branches of law and to the problematization of the foundations intrinsic to civil law
