  O artigo tem como objetivo responder a questão de saber se o direito deve assumir-se emancipatório tal como propõem as teorias críticas. Nosso pressuposto teórico é o de que esta pergunta merece uma resposta negativa. Para respondê-la, entretanto, e empregando o método da revisão de literatura, dividimos o artigo em três seções. Na primeira e na segunda seção, mapeamos e caracterizamos as teorias críticas no âmbito do pensamento científico em geral e, depois, as suas projeções problemáticas no pensamento jurídico. Na terceira seção, respondemos a partir do jurisprudencialismo às questões de saber se a emancipação constitui o referente fundante e fundamentante do direito, não mais o homem-pessoa, e, ainda, se constitui um problema de relevância jurídica que afinal mereceria uma resposta também jurídica. Concluímos, ao final, que o direito não deve substituir a validade que o constitui e que ele constitui pela emancipação social

  The article aims to answer the question of whether the law should be assumed emancipatory as proposed by critical theories. Our theoretical assumption is that this question deserves a negative response. To answer it, however, and using the method of literature review, we divide the article into three sections. In the first and second section, we map and characterize the critical theories in the general scientific thought and then their problematic projections in legal thinking. In the third section, we respond from jurisprudentialism the questions whether the emancipation is the founding referent of law, not the man-person, and also if it is a legal relevance problem that after all deserve an equally legal response. We concluded in the end that the Law should not replace the validity that it is for social emancipation.
