Propuesta de regulación de los internamientos involuntarios en centros geriátricos o sociosanitario

    El artículo 763 de la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, no se refiere al internamiento de personas que carecen de capacidad para decidir su internamiento voluntario en centros geriátricos. La doctrina y jurisprudencia están divididas en cuanto a la aplicación de este precepto a este tipo de internamientos. Se considera necesaria la regulación de este tipo de internamientos, teniendo como base para la reforma el respeto a las instrucciones previas que hubiera podido dar la persona sujeta a la medida y asimismo la normativa de la guarda de hecho, debiendo tenerse en cuenta la necesaria adecuación de nuestra legislación a la Convención Internacional de los Derechos de las Personas con Discapacidad de 2006

    Article 763 of Law 1/2000, of January 7th, of Civil Procedural, does not refer to the internment of people who lack the capacity to decide their voluntary interment in geriatric centres. The doctrine and jurisprudence are divided regarding the application of this article to this type of internment. It is considered necessary the regulation of this kind of internment, having as a basis for the reform the respect of the previous instructions that the person subject to the measure could have given, as well as the regulations of the de-facto guardian, taking into account the necessary adequacy of our legislation to the 2006 International Convention on the Rights of Persons with Disabilities.
