    Este estudio parte de la importancia y oportunidad de un diagnóstico diferencial de los fondos y las ayudas públicas. En la primera parte se analiza la jurisprudencia del TJUE que exige el carácter estratégico y viable de las empresas favorecidas por las ayudas públicas en las sentencias del Tribunal General de la Unión Europea de 17 de febrero de 2021 (asunto T-378/20 Ryanair DAC/Comisión y T-379/20 Ryanair DAC/Comisión) y en la Sentencia de 14 de abril de 2021 (asunto T-388/20 Ryanair DAC/Comisión).

    En la segunda parte, el Estudio hace un diagnóstico diferencial con la creación caótica de fondos públicos para ayudar a la recapitalización de las empresas españolas afectadas por la pandemia del Covid y la concesión arbitraria de ayudas públicas. El Estudio acaba ofreciendo unas conclusiones

    This study is based on the importance and opportunity of a differential diagnosis of funds and public aids. The first part analyzes the case law of the CJEU that requires the strategic and viable nature of the companies favored by public aid in the judgments of the General Court of the European Union of February 17, 2021 (case T-378/20 Ryanair DAC v Commission and T-379/20 Ryanair DAC v Commission and in the Judgment of April 14, 2021 (case T-388/20 Ryanair DOC v Commission).In the second part, the Study makes a differential diagnosis with the chaotic creation of public funds to help recapitalize Spanish companies affected by the Covid pandemic and the arbitrary granting of public aid. The Study ends by offering some conclusions.
