    La figura legislativa conocida como mecanismo de segunda oportunidad o beneficio de exoneración del crédito insatisfecho regulada en los artículos 486 y siguientes del Texto Refundido de la Ley Concursal se cimentó en la Ley 14/2013 y ha sido fruto de recomendaciones internacionales. Tras la profunda reforma introducida por la Ley 25/2015, el Gobierno ha usado el Real Decreto Legislativo 1/2020, por el que se Concursa! aprueba con el la Texto intención Refundido de de preparar la Ley La normativa para una más adecuada trasposición de la Directiva (UE) 2019/1023 en un horizonte temporal próximo. El presente artículo trata de analizar las diferencias de los dos mecanismos de acceso al beneficio de exoneración: el régimen general y el régimen especial.

    The legislative figure known as fresh start regulated in articles 486 et seq. of the consolidated text of the Bankruptcy Law was founded on Law 1412013 and has been the result of international recommendations. After the profound reform introduced by Law 25¡2015, the legislator has used Royal Legislative Decree 1/2020, which approves the consolidated text of the Bankruptcy Law with the mentIon of preparing the regulations for a more adequate transposition of the (EU) Directive 2019/1023 ín the near horizon. This article tries to analyze the differences between the two mechanIsms for accessing the fresh start: the general regime and the special regIme.
