Resumen de Luces y sombras de la exoneración del pasivo insatisfecho. Algunas propuestas de mejora

Con la aprobación del Texto Refundido de la Ley Concursal El beneficio de exoneración del pasivo insatisfecho adquiere una regulación sustancialmente más amplia y, en principio, clarificadora. El presente trabajo pretende hacer un análisis crítico de la misma, y trata de ahondar en aquellos aspectos más relevantes o novedosos. Todo ello con tal de intentar destacar las reformas que generan luces en comparación con la legislación precedente, y despejar aquellas otras que se mantienen sin resolver. De forma intercalada en ese análisis el autor aporta a título particular algunas mejoras del sistema, que redundan en favor no solo de los deudores sino también de los intereses de los acreedores. El trabajo termina con una reflexión final donde se pone de manifiesto -aunque suponga adelantar la conclusión-que las buenas intenciones del legislador se han quedado muy cortas.

With the approval of the Consolidated Text of. the Bankruptcy Law, discharge acquires a regulation that is substnially broader and, in principe, clarifying. The present work aims to make a cnt1cal analysis of it, and tries to delve into those most relevant or novel aspects. Ali this in order to try to highlight the reforms that generate lights in comparison with the previous legislation, and clear those others that remain unresolved. Interspersed in this analysis, the author contributes in a particular way sorne improvements to the system, which benefít not only the debtors but also the interests of the creditors. The work ends with a final reflection where it becomes clear -even if it means advancing the conclusion - that the good intentions of the legislator have fallen far short.
