Il captatore, tra luoghi e tempo…

    Le intercettazioni eseguite a mezzo di captatore informatico fanno risaltare la problematica concernente la tassativa individuazione dei luoghi di svolgimento delle relative attività. In particolare, muovendo dalla “sentenza Scurato”, si ritiene di dover censurare la prassi investigativa della attivazione del microfono al di fuori dei luoghi - anche se non di privata dimora - di svolgimento della attività delittuosa previamente individuati nel decreto autorizzativo. L’aspetto che rende la quaestio particolarmente interessante, infatti, attiene alla verifica della (in)utilizzabilità delle captazioni quand’anche le stesse abbiano interessato un luogo pubblico e non già un “luogo di privata dimora”.

    The wiretapping carried out by means of an IT pick-up highlights the problem concerning the mandatory identification of the places where the relative activities are carried out. In particular, starting from the "Scurato ruling", it is deemed necessary to censor the investigative practice of activating the microphone outside the places - even if not of private residence - of carrying out the criminal activity previously identified in the authorization decree. The aspect that makes the question particularly interesting, in fact, concerns the verification of the (in) usability of the captations even when they have affected a public place and not a "place of private residence".
