  • The implementation of the non-binding effect of unfair terms of the European Union law in our national legal system cannot be completed without clarifying the nature of the individual action for the nullity of a clause due to its unfairness and its relationship with the restitutory effects. Throughout the text, the origins of the problem, the case-law on article 1303 CC and the applicable principles of the case-law of the CJEU will be analysed in order to defend the fact that the action for nullity is unique and its effects are produced automatically by operation of Law.

    La implementación del efecto de no vinculación de las cláusulas abusivas del derecho de la Unión Europea en nuestro ordenamiento jurídico nacional no puede completarse sin clarificar la naturaleza de la acción individual de nulidad de una cláusula por su carácter abusivo y su relación con los efectos restitutorios. A lo largo del texto, se analizarán los orígenes del problema, la jurisprudencia sobre el artículo 1303 CC y los principios de la jurisprudencia del TJUE aplicables para tratar de defender que la acción de nulidad es única y sus efectos se producen automáticamente por ministerio de la Ley
