Violência doméstica: legislação e ações no estado de Pernambuco

    O presente trabalho tem como objeto de estudo a tutela governamental da violência doméstica e familiar no Estado de Pernambuco. Historicamente a legislação brasileira possuía vários dispositivos de discriminação negativa da mulher como o instituto da legítima defesa da honra. As agresões domésticas, muitas vezes legitimadas pelo Estado, tornaram-se insustentáveis depois dos diversos movimentos feministas, da intervenção dos organismos internacionais, da Constituição Federal de 1988 e dos tratados de direitos humanos que o Brasil se tornou signatário. Todos esses fatores modificaram a estrutura de pensamento que está refletindo na produção legislativa e ações governamentais que tutelam a violência doméstica com mecanismos de punição e prevenção da violência. Um grande marco foi a criação da Lei 11.340/2006, Lei Maria da Penha, que tipificou como crime e identificou algumas categorias de violência doméstica como: Violência doméstica e familiar contra a mulher, Violência física,Violência psicológica, Violência sexual, Violência patrimonial, Violência moral. A Lei 11.340/2006 além da classificação da violência também instituiu mecanismos punitivos, a implementação de ações educativas e promoção de estudos e pesquisas, estatísticas. De acordo com as estatísticas no estado de Pernambuco ocorreu aumento das notificações dos casos de violência doméstica e domiciliar. Entendemos que o aumento de notificações não só significa o aumento de conscientização dos crimes que são tipificados como violência doméstica como também a maior procura das vítimas pela tutela do Estado. Em Pernambuco além das ações punitivas encontramos a adoção de políticas públicas de modo integrado entre os poderes Executivo, Legislativo, Judiciário e a sociedade civil organizada.

    The present study aims to study the governmental protection of domestic and family violence in the State of Pernambuco. Historically the Brazilian legislation had several devices of negative discrimination of the woman as the institute of the legitimate defense of the honor. Domestic assaults, often legitimized by the state, became unsustainable after the various feminist movements, the intervention of international organizations, the Federal Constitution of 1988 and the human rights treaties that Brazil became a signatory. All these factors have altered the thinking structure that is reflected in the legislative production and governmental actions that protect domestic violence with mechanisms of punishment and violence prevention. A major milestone was the creation of Law 11.340 / 2006, Lei Maria da Penha, which criminalized and identified some categories of domestic violence as domestic and family violence against women, Physical violence, Psychological violence, Sexual violence, Violence, Moral violence. Law 11.340 / 2006, besides the classification of violence, also instituted punitive mechanisms, the implementation of educational actions and the promotion of studies and research, statistics. According to the statistics in the state of Pernambuco, there was an increase in notifications of cases of domestic and domestic violence. We understand that the increase in notifications not only means raising awareness of the crimes that are typified as domestic violence, but also the increased demand of victims for the protection of the State. In Pernambuco besides punitive actions we find the adoption of public policies in an integrated way between the Executive, Legislative, Judiciary and organized civil society
