Las resoluciones admiten el pacto de atribución de privaticidad sin precisar la causa específica de esa atribución que no puede confundirse con la causa onerosa de la propia adquisición del bien, lo cual implica una derogación tácita o eliminación por la vía fáctica del artículo 1324 Código Civil y de los artículos 95. 2º, 4º, 5º y 6º y 144 del Reglamento Hipotecario. La atribución por pacto del carácter privativo del bien solo cabe, o por confesión del consorte, sin perjuicio de los derechos de los acreedores y herederos forzosos –artículo 1324 del Código Civil, o por negocio de adquisición con expresión de causa –artículo 1323 del Código Civil-, sin que pueda confundirse la causa del negocio de adquisición con la causa de la atribución de privatividad que es exigible que se exprese y precise. No cabe construir el pacto de atribución de privaticidad a partir del pacto de atribución de ganancialidad, que está tipificado en el artículo 1355 del Código Civil y tiene causa matrimonii. The resolutions admit the Own Assets Agreement without determining its specific cause, which can not be confused with the onerous cause of the acquisition of the asset, implying the tacit revocation of on one hand, the article 1324 from the Civil Code and on the other hand, the articles 95. 2º, 4º, 5º, 6º and article 144 of the Mortgage Regulation. The atribution of an asset as a separate property because of a marital agreement can only happen by spouse confession, regardless of the creditors and inheritors rigths -article 1324 Civil Code-, or by an acquisition contract with a cause –article 1323 from the Civil Code-, but it is not possible to confuse the acquisition contract cause with the one of the Own Assets Agreement, which must have been set precisely. The Own Assests Agreement can not be built from the Joint assets agreement, which is defined in article 1355 of the Civil Code, and has causa matrimonii. Differently from the legislation from Navarra and Aragón, the Civil Code does not admit the Own Assets Agreement.
