Resumen de La intervención administrativa en los derechos fundamentales de las personas por motivos de salud pública

El trabajo recoge una reflexión sobre las nuevas potestades de intervención de la Administración el el ámbito de las libertades y derechos fundamentales de las personas. Se traducen en estrictos confinamientos domiciliarios, toques de queda nocturnos, confinamientos perimetrales, cuarentenas y en otras severas limitaciopnes de derechos que se justifican en la necesidad de proteger la salud pública y la vida de las personas. Sin embargo, la adopción de estas medidas es muy problemática porque no disponen de un marco jurídico adecuado que les dé cobertura. No han sido adecuadamente tipificadas ni reguladas por el legislador orgánico, con las exigencias de previsibilidad y certeza que exige nuestro Estado de Derecho. Ante esta carencia se ha tendio que recurrir al estado de alarma, que se ha configurado impropiamente como el nuevo marco jurídico que atribuye a alas Comuidades Autónomas potestades para limitar derechos fundamentales.

This paper presents some reflections on the new intervention powers on the part of the Administration in the field of fundamental rights and freedoms of citizens. These powers materialize in strict isolations, nighttime curfews, perimeter lockdowns, quarantine measures and other limitations of rights which are justified in the need to protect public health and peoples lives. However the adoption of the said measures is highly controversial as they lack the appropriate legal framework to provide their irnplementation. They have not been adequately typified nor regulated by the organic legislator, with the adequate foreseeability and legal security which our Sta te of Law requires, Facing this absence of legal framework, it was necessary to resort to the state of emergency, which has been improperly shaped as the new legal framework which attributes powers to the Autonomous Communities to limit fundamental riqhts
