La globalización desarrolló aún más la idea de un mundo sin fronteras con el intercam-bio veloz de informaciones, noticias, valores, y también de personas. Mientras la tendencia sería del aumento del flujo migratorio, políticas fueron creadas para contener el avance e imponer límites a la inmigración de extranjeros. El Derecho Penal fue un instrumento para regular estos intereses, de forma que el inmigrante se convirtió en un enemigo. Con esto quiero demostrar la influencia que la pandemia de Covid-19 tuvo sobre los flujos migratorios, sobre las respuestas gubernamentales y sobre la visión global de la sociedad. Por medio de esas reflexiones se quiere fomentar la disminución del expansionismo penal y mirar de que forma el Principio humanitario de la Prohibición al Retroceso puede auxiliar esta nueva perspectiva

The globalization improved the idea of a no border wide world, with fast exchange of money, information, news, and persons also. Even though the tendency would be an important increase of migratory flow, policies were created to reduce this advance and limit the immigration of foreigners. Penal Law was used to rule these interests, so the im-migrant turned into a real enemy, favoring a xenophobic vision of the outsiders, especially from certain regions. The present article intends to show the influence of COVID-19 into migratory flow, politics and the new global vision of the society. All these reflections must encourage the reduction of criminal expansionism and envision how the Principle of the fence setback could help with this perspective.
