La Directiva 93/13/CEE protege a los consumidores de la UE de las cláusulas y condiciones abusivas que pueden figurar en un contrato tipo de los bienes y servicios que compran. Introduce la noción de «buena fe» para evitar todo desequilibrio importante entre los derechos y las obligaciones mutuas. En el contexto del Nuevo Marco para los Consumidores, se modificó la Directiva 93/13/CEE mediante la Directiva (UE) 2019/2161, que tiene por objeto modernizar la legislación de la UE en materia de consumo y mejorar su aplicación. No obstante, el autor preconiza una adaptación de la Directiva relativa a las cláusulas abusivas a la situación actual caracterizada por un acelerado crecimiento del Mercado de servicios digitales
Directive 93/13/EEC protects consumers in the EU from unfair terms and conditions which might be included in a standard contract for goods and services they purchase. It introduces the notion of «good faith» to avoid any significant imbalance in mutual rights and obligations. As part of the New Deal for Consumers, Directive 93/13/EEC has been amended by Directive (EU) 2019/2161, which aims to modernise EU consumer law and improve its enforcement. Nevertheless, the author is in favour of an adaptation of the Directive on unfair terms to the current situation characterized by an accelerated growth of the market for digital services.
