La regulación del Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana (IIVTNU) presentaba un vicio de origen a la hora de determinar la base imponible ya que no partía del principio de capacidad económica. Esta configuración daba lugar a tributación aunque no existiera incremento de valor y, por lo tanto, capacidad contributiva alguna. Ello conllevó una gran conflictividad en los tribunales de la Jurisdicción, llegando a pronunciarse el Tribunal Constitucional en varias ocasiones declarando la nulidad de varios preceptos de la ley del impuesto, y alentando al legislador a modificar y adaptar dicha norma. Sin embargo, la debida regulación no se ha producido y ello ha derivado en una creciente inseguridad jurídica y, con ello, a un incremento de la conflictividad judicial. Este trabajo de investigación estudia la situación jurídica del impuesto antes y después de la Sentencia del Tribunal Constitucional 59/2017, y analiza, con una finalidad práctica, la abundante jurisprudencia dictada que está supliendo el déficit normativo
The IIVTNU regulation had a defect of origin when determining the tax base since it did not start from the principle of economic capacity. This configuration gave rise to taxation even if there was no increase in value and, therefore, no contribution capacity.
This led to great conflict in the courts of the Jurisdiction, with the Constitutional Court ruling on several occasions declaring the nullity of various provisions of the tax law, and encouraging the legislator to modify and adapt said rule. However, due regulation has not occurred and this has led to growing legal insecurity and, with it, to an increase in judicial conflict. This research work studies the legal situation of the tax before and after Constitutional Court Judgement 59/2017, and analyzes, with a practical purpose, the abundant jurisprudence that is supplying the regulatory deficit.
