Resumen de Los problemas en la gestión patrimonial de los bienes transferidos a las Universidades por la vía del artículo 80.2 de la LOU: mecanismos de solución

La Universidad pública española se encuentra ante una situación kafkiana en lo referente a la gestión de parte de su patrimonio inmobiliario, aquel que se le transfirió vía artículo 80.2 de la Ley Orgánica de Universidades. Por un lado, una porción de dicho patrimonio no se acomoda a sus actuales necesidades, por otro lado, si decidiera enajenarlo para financiar sus proyectosla Universidad se vería sometida a la obligación de revertir el bien al Estado o la Comunidad Autónoma. Se ha defendido que la enajenación del bien no permite ejercer el derecho de reversión cuando lo obtenido se reinvierte en el servicio universitario. Este artículo expone las razones por las que no es posible tal interpretación y ofrece una vía de solución a través de la permuta.

The Spanish public university is facing a Kaf kaesque situation in relation to the management of part of its Real Estate Propert y that was transferred via article 80.2 of the Organic Law of Universities. On the one hand, part of said patrimony does not suit its current needs, on the other hand, if it decided to sell it to finance its projects, it would be subject to the obligation to revert the property to the State or the Autonomous Community. It has been argued that the alienation of the property does not allow exercising the right of reversion when the proceeds are reinvested in the university service. This article exposes the reasons why this interpretation is not possible and offers a way of solution through the swap.
