Resumen de Regulación legal del régimen de responsabilidad patrimonial de la administración pública en Nicaragua: un pilar en construcción

Los particulares tienen derecho a ser indemnizados por la Administración Pública cuando sus derechos, bienes e intereses se ven lesionados por la actividad administrativa, a esto se le conoce como el principio de responsabilidad patrimonial. El presente trabajo aborda el régimen de responsabilidad patrimonial de la Administración Pública en Nicaragua y la necesidad de una regulación legal moderna que apunte a incorporar aspectos técnicos como la noción del funcionamiento de los servicios públicos, los requisitos de la lesión, el tipo de sistema y los títulos de imputación que permitan la efectiva implantación de un sistema de responsabilidad hasta ahora inactivo. Este artículo persigue aportar propuestas legales, apoyándose en el doctrina y en el Derecho Comparado de países como España y México, que sean capaces de llenar los vacíos sustantivos existentes en la materia de responsabilidad patrimonial en el ordenamiento jurídico administrativo nicaragüense, para que la seguridad jurídica y la garantía patrimonial de los administrados pueda verse reforzada.

Individuals have the right to be compensated by the Public Administration when their rights, assets and interests are injured by administrative activity, this is known as the principle of patrimonial responsibility. The present work deals with the regime of patrimonial responsibility of the Public Administration in Nicaragua and the need for a modern legal regulation that aims to incorporate technical aspects such as the notion of the operation of public services, the requirements of the injury, the type of system and the imputation titles to allow the effective implementation of a system of responsibility until now inactive. This article seeks to provide legal proposals, based on the doctrine and Comparative Law of countries such as Spain and Mexico, which are capable of filling the existing substantive and procedural gaps in the area of property liability in the Nicaraguan administrative legal system, so that the Legal certainty and the asset. guarantee of the individuals can be reinforced.
