In the year 2015, Congress converted MP 664 of December 30, 2014, in law 13.135 / 2015, generating a series of implications for the social protection of women, due to the modification of the conditions for granting the pension benefitby death. The IBGE projections indicate that, in 2020, there will be 7 men for every 10 women over 70, since the expectation of female survival is higher. The data show that the number of women reaching older age without partners and taking care of their family alone is higher, so that they are covered by social security. Withthe present qualitative study, through documentary and bibliographical research, the objective is to analyze, in an introductory way, possible implications of the legislative changes instituted by Law 13.135 / 2015 on the social protection of women, for death benefit benefits, and The occurrence of social etrogression.

No ano de 2015, o Congresso converteu a MP nº 664 de 30 de dezembro de 2014, na lei nº 13.135/2015, gerando uma série de implicações na proteção social da mulher, em razão da modificação das condições para concessão do benefício de pensão por morte. As projeções do IBGE dão conta que, em 2020, serão 7 homens para cada 10 mulheres com mais de 70 anos, já que a expectativa de sobrevida feminina é superior à masculina. Os dados mostram que é maior o número de mulheres atingindo idade avançada, sem companheiros e cuidando sozinha de sua família, motivo para que estejam amparadas pela previdência social. Com o presente estudo, de cunho qualitativo, através de pesquisa documental e bibliográfica, objetiva-se analisar, de maneira introdutória, eventuais implicações das alterações legislativas instituídas pela Lei nº 13.135/2015, na proteção social das mulheres, pelo benefício de pensão por morte e a ocorrência de retrocesso social.
