El Comité Europeo de Protección de Datos (CEPD) ha publicado un Dictamen sobre la interrelación entre el Reglamento de Ensayos Clínicos (REC) y el Reglamento General de Protección de Datos (RGPD). Tras subrayar que el consentimiento informado que requiere el REC y el consentimiento que regula el RGDP son conceptos jurídicos diferentes, el Comité presenta varias consideraciones sobre las bases jurídicas en las que cabe fundamentar el tratamiento de datos en el marco de ensayos clínicos, evitando sin embargo pronunciarse sobre las condiciones que permiten considerar un tratamiento ulterior de datos con fines de investigación científica «compatible» con el tratamiento original.
The European Data Protection Board (EDPB) has published an Opinion on the interplay between the Clinical Trials Regulation (CTR) and the General Data Protection regulation (GDPR), following a request by the European Commission. Stressing that informed consent under the CTR and consent under the GDPR are different legal notions, it puts forward considerations on which legal grounds may justify personal data processing in the context of clinical trials. The EDPB, however, postpones detailing the exact conditions that allow regarding further processing for scientific purposes to be compatible with a prior processing.
