    El informe que la Administración Concursal tiene que elaborar en la fase de calificación del concurso conforme a lo establecido en el artículo 448 del Real Decreto Legislativo 1/2020, de 5 de mayo, por el que se aprueba el texto refundido de la Ley Concursal, constituye una pieza básica para la finalización del procedimiento concursal. Nos encontramos ante un documento esencial para el Juez del concurso, ya que deberá basarse en él para dictar la Sentencia que califique el concurso como culpable o como fortuito. Sin embargo, a pesar de su importancia, a día de hoy todavía quedan por resolver importantes cuestiones respecto a este documento como son el discutible plazo para su elaboración o su controvertida naturaleza jurídica, cuestiones a las que se dará respuesta en el presente estudio.

    The report to be drawn up by the Bankruptcy Administration in the qualification phase of the competition in accordance with article 448 of Royal Legislative Decree 1/2020 of 5 May, approving the consolidated text of the Bankruptcy Act, is a basic piece for the completion of the bankruptcy procedure. We have before us an essential document for the Judge of the contest, since it must be based on him to dictate the Judgment that qualifies the contest as guilty or as fortuitous.

    However, in spite of its importance, today there are still important issues to be resolved with regard to this document, such as the questionable time frame for its preparation or its controversial legal nature, issues that will be response in this study.
