A través de este trabajo se expone la importante doctrina establecida por el Tribunal Supremo en su sentencia de 23 de noviembre de 2020, al hilo del caso Colgate Palmolive. El Alto tribunal se pronuncia sobre la controvertida cuestión relativa a la exigencia del requisito del beneficiario efectivo como condición de aplicación de un convenio de doble imposición. El Tribunal Supremo entiende que el principio del beneficiario efectivo no puede considerarse incluido implícitamente en los Convenios de doble imposición, ni puede fundamentarse su exigencia invocando la interpretación a la luz de los Comentarios al MC OCDE. La doctrina fijada en esta sentencia completa la establecida en su precedente Stryker, limitando la utilización del Soft-law a los efectos de la interpretación y aplicación de la red española de convenios de doble imposición.
Through this article, the important doctrine established by the Supreme Court in its judgment of November 23, 2020, in connection with the Colgate Palmolive case, is exposed. The Supreme Court ruled on the controversial issue regarding the requirement of the beneficial owner as a condition of application of a double taxation agreement. The Supreme Court held that the principle of beneficial ownership cannot be considered to be implicitly included in Double Taxation Agreements, nor can its demand be substantiated by invoking the interpretation in light of the Commentaries to the OECD Model Convention. The jurisprudence established in this judgment completes that established in its preceding leading case Stryker, limiting the use of Soft-law for the purposes of the interpretation and application of the Spanish network of double taxation agreements.
