    La discusión en torno a la teoría de la inexistencia en el derecho chileno presenta diversas posturas. Hay quienes están a favor de concebir la inexistencia como sanción y muchos que la niegan tajantemente; e incluso, algunos innovadores que toman una posición ecléctica frente al tema. Asimismo, los Tribunales Superiores de Justicia chilenos no han podido ponerse de acuerdo en este tema, en donde existen fallos que acogen la teoría, la rechazan, o simplemente la confunden.

    The discussion around the theory of non-existence in Chilean law presents different positions. There are those who are in favor of conceiving non-existence as a sanction and many who strongly deny it; and even some innovators who take an eclectic position on the subject. Likewise, the Chilean Superior Courts of Justice have not agreed on this issue, and there are rulings that accept the theory, reject it, or simply confuse it.
