El presente artículo tiene como propósito la crítica del discurso jurídico moderno en Nuestra América, desde la perspectiva de la mitología jurídica. La tesis principal consiste en que la ciencia jurídica, al negar o ignorar su fundamento mítico, encubre las relaciones desiguales de poder y de saber que definen y construyen el discurso del derecho. Desde una posición teórico-crítica nuestroamericana, se revisará, en primer lugar, la concepción del derecho como discurso y campo social, así como la emergencia de las zonas del no-ser. En segundo lugar, se abordará el fundamento mítico de la ciencia jurídica y dos ejemplos de configuraciones míticas del discurso del derecho. Finalmente, el artículo concluye que, para realizar un derecho intercutural, decolonial y para la emancipación, se necesita una apertura discursiva de mitos y cosmologías, acompañada de la reivindicación de saberes jurídicos y derechos alternativos.
This article has the purpose of making a critique of modern legal discourse in “Nuestra América”, from the perspective of legal mythology. The main thesis is that legal science, by denying or ignoring its mythical basis, masks the unequal relations of power and knowledge that define and construct the discourse of law. From a decolonial and critical position, we will review the conception of law as discourse and social field, and the emergence of the “no-ser” zones. Later, we will analyze the mythical foundation of legal science and two examples of mythical configurations of legal discourse. Finally, the document concludes that a discursive opening of myths and cosmologies is needed, in order to produce an intercultural, decolonial and emancipative law. It is also important the recognition of different forms of legal knowledge and alternative human rights.
