El sorprendente anteproyecto de LOPJ

    La propuesta de una nueva Ley Orgánica del Poder Judicial, para sustituir a la Ley Orgánica 6/1985, ha tenido mucho más recorrido, y el Ministro ha presentado un informe sobre este Anteproyecto (en adelante, APLOJ) al Consejo de Ministros el 4 de abril de 2014, texto prelegislativo que se aparta en cuestiones relevantes del propuesto por la Comisión Institucional. Además ha enviado el texto para el preceptivo informe al Consejo General del Poder Judicial, que lo ha emitido, con la urgencia que desde el Gobierno se le pedía, el 27 de junio de 2014, con una extensión de 713 páginas.

    El texto proyectado nos trae una sustitución íntegra de la vigente Ley Orgánica del Poder Judicial de 1985, que ha tenido en sus escasos treinta años de vigencia cuarenta reformas, aunque de muy diversa entidad, en su mayoría retoques exigidos por otras disposiciones sin modificar la esencia de lo que debe regular la LOPJ, como dispone el art. 122.1 de la CE: la constitución, funcionamiento y gobierno de los Juzgados y Tribunales, así como el estatuto jurídico de los Jueces y Magistrados de carrera, que formarán un Cuerpo único, y del personal al servicio de la Administración de Justicia.

    The proposal for a new Organic Law of the Judiciary, in replacement of Organic Law 6/1985, has come a long way; the Minister submitted a report on this draft bill (from now on APLOJ) to the Council of Ministers of April 4th, 2014, a pre-legislative text which deviates from the proposal of the Institutional Committee on critical issues. The text was submitted as well to the General Council of the Judiciary for its obligatory report, which, amounting a total of 713 pages was already issued on June 27th, 2014, as urgently as the Government demanded.

    The draft text offers a complete replacement of the operative Organic Law of the Judicial Branch of 1985, which has undergone forty amendments during its short thirty years in force. The depth of these amendments has been very diverse, being mostly retouches required by other regulations that did not alter the essence of what this Law must regulate, as provided for under section 122.1 of the Spanish Constitution: the setting up, operation and internal administration of courts and tribunals as well as the legal status of professional judges and magistrates, who shall form a single body, and of the staff serving in the administration of justice.
